1.0 Introduction
The entrance examination for the selection to all Health Science Degree Courses, Engineering and Pharmacy degree courses in State of Maharashtra for the academic year 2009-2010 shall be conducted by the Competent Authority appointed by Government of Maharashtra. The Common Entrance Test (MHTCET 2009) will be held on Thursday, 7th May 2009, at all the district headquarters in the State of Maharashtra. The Selection Process shall however be separate for degree courses in Health Sciences, Engineering and Pharmacy. The respective Competent Authorities shall devise the system of Counseling/Allotment. This procedure shall be governed by the regulations and directions as specified by the Government of Maharashtra from time to time. This brochure gives the rules for the eligibility for appearing to the Maharashtra Health–Technical Common Entrance Test 2009 i.e. MHT-CET 2009, the eligibility for admission to first year of various courses in Engineering/Technology in the State of Maharashtra and also gives definition of various types of candidatures. These rules govern only the aspect of the ‘Common Entrance Test’ and the eligibility of the candidates to appear at this examination. The rules and information regarding the Distribution of seats under various heads i.e. Home University, Outside Home University, Institute Level seats, Minority seats, AIEEE seats etc.; details of the Reservation of seats, Fees concession (if any) offered to eligible candidates, details of the Centralized Admission Process (CAP), details of the Admission rounds, Institute/course wise Information etc. shall be provided in a separate Information Brochure, which will be made available to the aspiring candidates at the time of filling up of the Application Form for Admission to Engineering/Technology Courses. It is specifically made clear that the CET proposed to be conducted in terms of these rules will also govern the admissions of the Autonomous Institutes [viz. i) Veermata Jijabai Technological Institute (VJTI), Mumbai, ii) College of Engineering, Pune, (Formerly Government College of Engg., Pune) iii) Shri Guru Gobind Singhji Institute of Engineering & Technology (SGGSIET), Nanded iv) Walchand College of Engineering, Sangli. & V) Vishwakrma Institute of Technology, Pune (VIT)] and Deemed University i.e Institute of Chemical Technology (UICT), Mumbai. However the Admission process for these Autonomous institutes/Deemed University (and of any other Autonomous Institute upon receiving the permission from the State Government) will be separately carried out by the competent authorities appointed by these institutes. There will be a separate Information Brochure specifying the rules of admission to the above mentioned Autonomous institutes / Deemed University.

1.2 Definitions:

    1. ‘State Government’ means the Government of Maharashtra.
    2. ‘Director’ means the Director of Technical Education, Maharashtra State.
    3. "Application Form" means prescribed form filled up by the candidate for appearing for MHT-CET 2009.
    4. “Appeal Committee” means the Committee setup under the chairmanship of the Competent Authority; it shall deal with the representations submitted by the candidates/parents relating to grievances of the candidates with regard to MHT-CET-2009 examination and the selection process.
    5. “Competent Authority” means the Authority designated or appointed by Government of Maharashtra to conduct MHT-CET 2009, and declare the results. The respective Competent Authorities will supervise and control the selection process for the admission to Health Sciences, Engineering and Pharmacy degree courses and act as a chairperson of the Appeal Committee for representations submitted by the candidates. The Competent Authority will issue necessary executive instructions for implementation and provide relevant information to be published or communicated.
    6. ‘Representative of the Competent Authority’ means an officer appointed to assist Competent Authority for smooth conduct of Admission Process as per the directives of the Competent Authority.
    7. “Center in-charge of the District” means the District Collector or the officer(s) authorized by the District Collector.
    8. “Sub-Center in-Charge” means the officer in-charge of the High School/College where the MHTCET 2009 examination is being conducted.
    9. Divisional Authority” means the Dean/Officer(s) of specified Government Medical Colleges who will be responsible to carry out the directions and instructions of the Competent Authority.
    10. “Notified Colleges” means the colleges/institutions responsible for distribution of information brochures and application forms for MHT-CET-2009 examination, receipt of the application forms from the School/Jr. colleges, collection & distribution of admit cards and mark sheets of MHT-CET- 2009 examination.(Refer Annexure - A)
    11. “Qualifying examination” means examination on the result of which a candidate becomes eligible to appear at MHT-CET 2009 entrance examination. i.e. HSC(12th standard) or equivalent examination
    12. College’ or ‘Institution’ means Engineering College or Technological Institution duly approved by the AICTE and Government of Maharashtra to impart Education in Engineering/ Technology at the degree level.
    13. ‘Government Engineering College’ means the Engineering College run by the Government of Maharashtra.
    14. ‘Government Aided Engineering College’ means Engineering College run by private management but which receives financial assistance from the Government of Maharashtra.
    15. ‘University Managed Engineering College’ means Engineering College run by a particular University.
    16. ‘University Department’ means a department of University which offers four year degree courses in Engineering/Technology.
    17. ‘Autonomous Institute’ means the institute for which autonomy is granted by the Government of Maharashtra.
    18. ‘Un-Aided Engineering College’ means Engineering College run by private management on self financing basis.
    19. ‘Sanctioned Intake’ means the course wise number of seats sanctioned by the Government Resolution with reference to the AICTE’s approval.
    20. ‘Inter se merit’ means the order of merit as defined by Maharashtra State Merit list/Home University area merit list/All India (AIEEE) Merit list/J & K Migrant Merit list as the case may be.
    21. ‘Candidate’ means an applicant who is an Indian National and desires to appear for MHT-CET- 2009 with an intention to seek admission to first year of four year Degree Courses in Engineering/Technology in Maharashtra State by submitting the prescribed application form for the year 2009-2010.
    22. “Defense” means services established under the Army Act 1950/Air force Act 1950/Navy Act 1957.
    23. ‘F.E. Admission’ means the Admission to first year of four year degree courses in Engineering /Technology.
    24. Persons of Indian Origin (PIO)”: A Person having foreign citizenship (except Pakistan and Bangladesh) without “NRI” status, who holds a Foreign Passport at the time of sending application, consideration for admission and during the period of his/her study, and he/she or anyone/both of his/her parents or anyone/both of his/her grandparents is (or was)/are (or were) citizen(s) of India by virtue of the provisions of the Constitution of India or Sec. 2(b) of Citizenship Act, 1955 (Act No. 57 of 1955).
    25. ‘OMS candidate’ means Outside Maharashtra State candidate who is an Indian National.
    26. ‘Foreign Nationals’ means Citizens of all countries other than India, who are not of Indian origins defined under PIO.
    27. ‘Foreign Student’ means Foreign Student in this context shall be defined as the student who possesses a foreign passport.
    28. CAP Seats’ These are the seats for which allotment/admission is carried out by the Competent Authority through CAP
    29. NRI’: Non Resident Indian as per the definition given in the section 6 of the Income Tax Act 1961.
    30. ‘NRI Candidate’ means a candidate who is a child/ward of the person who has the ‘NRI status’ as defined under section 6 of the Income Tax Act.
2.0 Eligibility Criteria:
 
2.1. Eligibility of Maharashtra State Candidate and OMS candidate for appearing for MHT-CET-2009:

Candidate should be an Indian National and should have passed/appeared* the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistry and Mathematics.

 

NOTE:
  • *Candidates who have appeared for the qualifying examination i.e. HSC (Std. XII) or its equivalent examination during the academic year 2008-09 and whose results are not declared till the last date of submission of application form are eligible to appear for MHT-CET-2009, however for admission to first year of degree courses in Engineering/Technology, such candidates must fulfill the eligibility criteria as mentioned in rules 2.2 to 2.10 as applicable.
  • Maharashtra State candidates (defined as per rule no. 3.1) and OMS candidates (defined as per rule no. 3.2) are eligible to appear for the MHT-CET-2009 conducted by the Competent Authority of Government of Maharashtra for the academic year 2009-2010.
  • Even though Outside Maharashtra State (OMS) candidates are eligible to appear for the MHT-CET- 2009, it is specifically made clear that such OMS candidates will not be able to participate in the Centralized Admission Process on the basis of score in MHT-CET 2009. These OMS candidates will be able to apply for the admissions against the Institute Level seats as well as the vacancy round of admission after completion of Centralized Admission Process, ONLY in the Unaided Private Engineering Colleges/Institutes on the basis of score in MHT-CET 2009.
  • The facility of Constitutional Reservation (Annexure-II) is not available for the OMS candidates. Therefore all OMS candidates will be treated as OPEN/GENERAL category candidates in the entire admission process.

2.2. Eligibility criteria for Maharashtra State Candidate and Outside Maharashtra State Candidate for admission to first year of degree courses in Engineering/Technology:

Candidate should be an Indian National and should have passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistry and Mathematics AND Secured minimum 50% marks i.e. not less than 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks in case of candidates of Backward class categories belonging only to Maharashtra State) in the subjects Physics, Chemistry and Mathematics added together AND Obtained a non zero score in subjects Physics, Chemistry and Mathematics added together at MHT-CET 2009.

 

2.3. Eligibility Criteria for All India (Paper-I of AIEEE-2009 qualified) candidates: [both the Maharashtra Candidates i.e. Type A, B, C, D, E and F (refer rule no. 3.1) and the OMS candidates (refer rule no. 3.2)]

Candidate should be an Indian National and should have passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistry and Mathematics AND secured minimum 50% marks i.e. not less than 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks in case of candidates of Backward class categories belonging only to Maharashtra State) in the subjects Physics, Chemistry and Mathematics added together AND Candidate should have a valid AIEEE Score (i.e. total score should be positive) for the year 2009-2010.

 

2.4. Eligibility Criteria for Foreign National/Foreign student/ PIO/Children of Indian workers in the Gulf countries/Children of NRI
  • The NRI candidates are eligible to apply for admission against the Institute level seats, only in Unaided Private Engineering Colleges/Institutes. The extent to which such NRI candidates shall be admitted is limited to 15% of the sanctioned intake.
  • The eligibility of the candidates passing the HSC (Std. XII) equivalent examination from a school/college/Examination Board situate outside India shall be further decided by the University Authorities to which the candidate is admitted. Hence such candidates are advised to get their eligibility verified by the respective University Authorities before seeking admission to the Engineering courses in the State of Maharashtra.
  • The candidate belonging to this type is not required to appear for the MHT-CET 2009/AIEEE 2009.

2.5. Eligibility criteria for GOI nominees:

 

Candidate should be an Indian National and should have passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistry and Mathematics and secured minimum 50% marks i.e. not less than 150 marks out of 300 marks (minimum 45% marks i.e. not less than 135 marks out of 300 marks in case of candidates of Backward class categories) in the subjects Physics, Chemistry and Mathematics added together.
Note:-
  • The candidate belonging to this type is not required to appear for the MHT-CET 2009/AIEEE 2009.

2.6. Eligibility criteria for J & K Migrant candidates:

 

Candidate should be an Indian National and should have passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination with subjects English, Physics, Chemistry and Mathematics and secured minimum 50% marks i.e. not less than 150 marks out of 300 marks in the subjects Physics, Chemistry and Mathematics added together.
Note:-
  • The candidate belonging to this type is not required to appear for the MHT-CET 2009/AIEEE 2009.

2.7. Eligibility criteria for MKB candidates:

 

In addition to the basic eligibility criterion mentioned in rule no. 2.2, candidates who have appeared & obtained a non zero score in the MHT-CET 2009 and belonging to the Maharashtra Karnataka Disputed Border Area are required to fulfil following additional eligibility criterions.
  • Candidates have to be from such villages/towns, from the Maharashtra Karnataka disputed border areas, on which Maharashtra puts its claim (Refer Annexure I).
  • The candidate should produce the certificate that his/her father/mother/candidate himself/herself is a domicile of Karnataka in the disputed border area as specified in the Proforma G1/G2 OR The candidate should produce the domicile certificate of his/her father/mother/candidate himself/herself stating that he/she is a resident of a village mentioned in Annexure –I.
  • The candidate should have passed SSC (or equivalent) and/or HSC (or equivalent) from an Institution situate in the disputed border area. The candidate must produce a certificate from the Principal/Head Master of the College/School stating that the candidate has passed SSC/HSC (or equivalent) Examination from that Institution.
  • Mother tongue of the candidate must be Marathi. The candidate must produce a certificate from the Principal/Head Master of the School from which he/she has passed the SSC (or equivalent) Examination, stating that the candidate’s Mother tongue is Marathi as per the original School record.
  • Candidate should have passed SSC or HSC (or equivalent) Examination with Marathi as one of the subject.

2.8. Eligibility criteria for Candidates who are sons/daughters of Defense service personnel:

 

In addition to the basic eligibility criterion mentioned in rule no.2.2, candidates who have appeared & obtained a non zero score in the MHT-CET 2009 and satisfying any one of the following criteria as are eligible to seek admission against seats for sons/daughters of defense service personnel.
  • Candidate is a son/daughter of ex-service personnel who is domiciled in Maharashtra State (Def-1).
  • Candidate is a son/daughter of active service personnel who is domiciled in Maharashtra State (Def-2).
  • Candidate is a son/daughter of active service personnel (Def -3)
  • Who is transferred to Maharashtra State but is not domiciled in Maharashtra State
  • Who is not domiciled in Maharashtra State but his/her family is stationed in Maharashtra State under the provision of retention of family accommodation at the last duty station on the grounds of childrens’ education, provided further that, such candidate should have appeared and passed the HSC (Std.XII) examination of Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent examination from a school/college situate in the State of Maharashtra.
Note:
This provision is NOT available to the children of CIVILIAN STAFF who is working/ who has worked with the Indian Defense Services.

2.9. Eligibility criteria for Candidates who are Physically Handicapped:

 

In addition to the basic qualification mentioned in rule no. 2.2, candidate who has appeared & obtained a non zero score in the MHT-CET 2009 and suffering from any one of the following permanent disability is eligible to seek admission against seats for Physically Handicapped candidates [only Maharashtra State candidates (Type A,B,C,D,E and F) are eligible to apply for admission against these seats]
  • Candidate who is visually impaired (blind) candidate (type P1)
  • Candidate who is speech & hearing impaired (deaf & dumb) candidate (type P2)
  • Candidate who is with orthopedic disorders, learning disabilities, Dyslexia, Dyscalculia, Dysgraphica, Spastic (type P3)

Note:
The certificate (proforma F/F-1) should clearly state that the extent of disability is more than 40% and the disability is permanent in nature.

2.10. Other eligibility criteria for specialized branches of Engineering:

 

Candidates seeking admission to some special courses or under some special provisions have to fulfill the following additional eligibility criteria.
  • Admission to Bio- Medical/Bio-tech Engineering course :

  • Candidates seeking admission to Biomedical/Bio-Tech Engineering course should have passed in the subject of Biology in the qualifying examination in addition to fulfilling the Eligibility criteria as mentioned in rule no. 2.1.
  • Admission to Mining Engineering course:

  • Female candidates are not eligible for admission to Mining Engineering course.
  • Admission to Marine Engineering Course
  • in Padm. Vasantdada Patil Pratishtan’s College of Engineering, Sion, Mumbai : Candidates aspiring to take admission to Marine Engineering Course in the following institute should directly contact the Principal of the college for eligibility criteria (Educational Qualification & Entrance Test) and admission process.

2.11. Eligibility criteria of Candidates who have passed/passing Diploma in Engineering/Technology and seeking admission to First Year of Engineering/Technology in Unaided Institutes: (Against Institute Level Seats, Vacant seats after the completion of CAP rounds)

 

Diploma holders who have passed the Diploma course in Engineering/Technology with minimum of 50% marks and medium of instruction as English from the Polytechnics affiliated to MSBTE or AICTE approved autonomous Polytechnics in Maharashtra State ( for Maharashtra State Candidates) or such polytechnics situate inside/outside the State of Maharashtra ( for Outside Maharashtra State Candidates).
Note:
  • To resolve a tie i.e. more than one candidate securing equal aggregate marks in Final year of the Diploma exam, following order of preference shall be adopted: marks in Maths at SSC, Grand Total at SSC.
  • Eligible Diploma candidates (rule 2.11) shall be considered for Admission against the Institute level seats, vacant seats existing after completion of the Centralized Admission Process in Unaided Private Institutes only. The details of the admission process for filling application for admission against vacant seats shall be made available in the separate information brochure.
  • Such Diploma candidates (rule 2.11) are not eligible to appear for the MHT-CET 2009.
General Notes:
  1. In case the maximum marks in individual subject is other than 100, convert the marks out of 100 for individual subject but do not round off these marks. If the sum of the converted marks of three individual subjects without rounding off works out to be a figure with fraction then fraction up to two decimal places will only be considered Example: If a candidate obtains 101 marks out of 200 in Physics, 86 marks out of 150 in Chemistry and 40 Marks out of 100 in Mathematics, then the sum of marks obtained works out to be 227 out of 450 marks. If it is conveted out of 300, it works out to be 151.33. However if the marks in individual subject are converted out of 100, then the marks are as 50.5 in Physics, 57.3333 in Chemistry and 40 in Mathematics. It means the sum of converted marks of individual subject is 147.8333, which is 147.83 up to two fractions. Hence the candidate is not eligible for admission under OPEN Category.
  2. If letter grades are assigned instead of marks at SSC, HSC or its equivalent examination the candidate must obtain the certificate of conversion of letter of grades into marks from the competent authority where from the candidate has passed the examination. The candidate should produce such certificate at the time of submission of application form. The Eligibility shall be decided based on the equivalent marks submitted by such candidates.
  3. If the candidate reappears for the qualifying examination (Std. XII or its equivalent) with all subjects then the marks obtained in the latest examination will only be considered for determining the eligibility criterion.
3.0 Type of Candidature:
3.1 Types of Maharashtra State Candidates and Home Universities:
A candidate is considered eligible for admission to the seats of Maharashtra State coming under the purview of competent authority subject to fulfillment of any one of the eligibility requirements as listed in the following table.

3.2 Outside Maharashtra State candidate:
Type of candidature: Outside
Maharashtra State candidate
(OMS)

OMS candidate should be an Indian national, who is not satisfying any of the
conditions Stated in Sr. No. 1,2, 3, 4,5,6 (i.e. Type A,B,C,D,E,F) of rule 3.1
and should have passed HSC(Std. XII) examination from an institute situate
outside State of Maharashtra within India.

Note:
  • Claiming facility under Type B, C, D, E & F is optional and it is binding for the candidates to produce the documentary proof along with the application form for CAP to claim the facility.
  • Candidate can claim only one type of candidature while submitting the application form. e.g. Candidates who are eligible to apply against the provision of Jammu & Kashmir Migrant Candidate seats as well as against the Maharashtra State seats are only entitled to claim for one of these seats.
  • Refer proforma A for Type-C, proforma B for Type-D/E and proforma H for Type-F candidates. The candidate should submit the certificate in the necessary proforma at the time of filling up of Application Form for CAP.
  • Eligible OMS candidates shall be considered on the basis of score of MHT-CET 2009, for Admission to institute level seats as well as against the vacant seats existing in Unaided Private Institutes, after completion of the Centralized Admission Process. The details of the admission process for filling up vacant seats and the institute level seats shall be made available in a separate information brochure.
4.0 Assignment of merit number:

4.1 Merit Number:

 

4.1.1 Each eligible Maharashtra State Candidate (Rule 2.2) who has appeared for MHT-CET 2009 and obtained a non zero score in MHT-CET 2009 and submitted application form on or before the last date prescribed for the submission of Application Form for Admission to Engineering through CAP will be assigned a provisional merit number. Merit of all eligible Maharashtra State candidates will be based on the MHT-CET 2009 score (out of 200 marks) only; relative merit in case of a tie (i.e. equal marks in MHT-CET 2009) shall be resolved as per rule no. 4.2.

4.1.2 OMS candidates should note that, a separate merit list of all eligible OMS candidates (Rule 2.2) shall be prepared based on the MHT-CET 2009 score (out of 200 marks) only, relative merit in case of a tie (i.e. equal marks in MHT-CET 2009) shall be resolved as per rule no. 4.2.

 

Note:
  1. Merit list of Maharashtra State Candidates so prepared shall indicate a State level General Merit No., State level Category Merit no. (as applicable), Home University General Merit No., Home University Category Merit no. (as applicable) etc.
  2. Assignment of a Merit number does not indicate or ensure admission to any seat.
4.2 Relative merit in case of a tie:
In the case of candidates securing equal number of marks in MHT-CET-2009, their relative merit will be fixed on the basis of the following order of preference:
  1. A candidate securing higher marks out of 100 in the subject of Mathematics in MHT-CET-2009.
  2. A candidate securing higher marks out of 50 in the subject of Physics in MHT-CET-2009.
  3. A candidate passing the SSC (Std. X) examination with higher aggregate marks out of 750.
  4. A candidate securing higher marks out of 150 in the subject of Mathematics at SSC (Std. X) Examination.
  5. Birth Date of the candidate (Elder Candidate will be given preference)
Note:

While converting the marks e.g. out of 750, if the converted marks work out to be a figure with fraction, fraction up to two decimal places will only be considered.

 

4.3 Change of Marks due to verification:
  • If the marks in the qualifying examination are modified due to verification and the same is duly certified by the Maharashtra State Board of Secondary and Higher Secondary Education or its equivalent, the same shall be reported to the ARC incharge immediately.
  • However the effect of the change will be taken into consideration only for the subsequent round(s) of admission.
5.0 Conduct and Discipline
  • Failure of the candidate in making full and correct Statements in the application form and/or suppression of any information and/or submission of false documents shall lead to disqualification of the candidate for MHT-CET 2009 or even at later date during the Admission Process. Such a candidate will be debarred from the examination as well as the entire selection process. Therefore the candidate is required to make only such claims which could be substantiated by relevant original documents.
  • Adopting any unfair means or engaging in malpractice in the examination shall render a candidate liable for punishment under, “Maharashtra Prevention of Malpractices Act, Universities, Board and Other Specified Examination Act, 1982” and disqualify him/her for MHT-CET-2009 examination.
  • If any person(s) or officer(s) dealing with the conduct of the MHT-CET-2009 are found engaged in act(s) that would result in the leakage of question paper or attempt to use or help in the use of unfair means in this examination he/she shall be liable to prosecution under Indian Penal Code.
  • Any issue not dealt here-in above will be dealt with, when arising, fully and finally by the Competent Authority.
